Terms of Service

These Terms of Service ("Terms") govern your access to and use of Winuss ("Service"), a task and client workflow platform operated by Aditya Deshmukh ("Winuss", "we", "us", "our"). By creating an account or otherwise using the Service, you agree to these Terms. If you are using the Service on behalf of an organisation, you confirm you have authority to bind that organisation.
1. The Service
Winuss provides a multi-tenant SaaS workspace that lets professional services firms create tasks, assign work to associates and managers, track client requests, and review and bill completed work.
2. Accounts
You must provide accurate registration information and keep it up to date. You are responsible for safeguarding your account credentials and for all activity that occurs under your account.
3. Acceptable Use
You agree not to misuse the Service. In particular, you will not:
- use the Service for any unlawful, fraudulent or deceptive purpose;
- send spam or other unsolicited communications;
- infringe the intellectual property or privacy rights of any person;
- introduce malware, probe, scan, or otherwise attempt to compromise the security of the Service;
- scrape, harvest or extract data from the Service except as expressly permitted.
4. Intellectual Property
Winuss and all related software, documentation, branding and trademarks are and remain the exclusive property of Aditya Deshmukh. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with your selected plan. You retain ownership of the data you submit to the Service.
5. Payments, Subscriptions & Merchant of Record
Paid plans are billed on a recurring monthly basis. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, taxes, cancellations and refunds are governed by Paddle's Buyer Terms in addition to these Terms.
6. Service Levels
We work hard to keep the Service available, but we do not guarantee that it will be uninterrupted, timely, secure, or error-free. The Service is provided "as is" and, to the fullest extent permitted by law, we disclaim all implied warranties including merchantability and fitness for a particular purpose.
7. Suspension and Termination
We may suspend or terminate your access to the Service if you materially breach these Terms, fail to pay fees when due, or pose a security or fraud risk to us or other users. You may cancel your subscription at any time through the billing portal. On termination, you may export your data for a reasonable period before it is deleted.
8. Limitation of Liability
To the maximum extent permitted by law, our aggregate liability for any claim arising from or relating to the Service will not exceed the fees paid by you to Winuss in the twelve (12) months preceding the event giving rise to the claim. We will not be liable for any indirect, incidental, special, or consequential damages, including loss of profits, data, or goodwill. Nothing in these Terms limits liability for fraud, death or personal injury where such limitation is not permitted by law.
9. Governing Law
These Terms are governed by the laws of India. The courts located in India will have exclusive jurisdiction over any dispute arising from these Terms.
10. Changes
We may update these Terms from time to time. Material changes will be communicated through the Service or by email. Continued use of the Service after the changes take effect constitutes acceptance of the revised Terms.
